Public offer
Public offer this Agreement is an official and public offer of the Seller to conclude a contract of sale of the Goods presented on the website gidrolica.ua. This agreement is public, that is, according to Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of status (individual, legal entity, individual entrepreneur). By entering into this Agreement, the buyer fully accepts the terms and conditions of ordering, payment for the goods, delivery of the goods, return of the goods, responsibility for unfair ordering, and all other terms of the agreement. The agreement is considered concluded from the moment of pressing the "Order confirmed" button on the order processing page and receiving confirmation of the order from the Seller in electronic form.

Definition of terms
- Goods or Service - the object of the agreement between the parties, which was selected by the buyer on the website of the Internet store and placed in the cart, or already purchased by the Buyer from the Seller remotely.
- Internet store - the Seller's website at gidrolica.ua, created for the conclusion of retail and wholesale purchase and sale contracts based on the Buyer's familiarization with the Seller's description of the Goods via the Internet.
- Buyer - a capable individual who has reached the age of 18, receives information from the Seller, places an order for the purchase of goods presented on the website of the Internet store for purposes not related to entrepreneurial activity, or a legal entity or individual entrepreneur.
- Seller - FOP Verbicka N.P. (Identification code 2011904083).

Subject of the agreement
- The Seller undertakes to transfer the Goods to the Buyer's ownership, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement.
- The date of conclusion of the Offer Agreement (acceptance of the offer) and the moment of full and unconditional acceptance of the conditions of the Agreement by the Buyer is considered the date of filling out the order form by the Buyer, located on the website of the Internet store, provided that the Buyer receives confirmation of the order from the Seller in electronic form. If necessary, at the Buyer's request, the Agreement can be formalized in writing.
- In cases provided for by the current legislation of Ukraine, the Seller provides the Buyer with a settlement document of the established form and content, created in paper and/or electronic form. The electronic settlement document is provided to the Buyer in any of the following ways: by reproducing on the display of the program recorder of settlement operations (display of the device on which the program recorder of settlement operations is installed) a QR code that allows a person to read and identify it with the settlement document by the data structure contained in it; by sending an electronic settlement document to the Buyer's provided subscriber number or email address; in another way provided by the current legislation of Ukraine.

Order processing
- The Buyer independently places an order in the Internet store through the "Cart" form, or by placing an order by email or by the phone number indicated in the contact section of the Internet store.
- The Seller has the right to refuse to transfer the order to the Buyer if the information provided by the Buyer when placing the order is incomplete or raises suspicion about its veracity.

Prices of Goods
- Prices for Goods and services are determined by the Seller independently and indicated on the website of the Internet store. All prices for Goods and services are indicated on the website in hryvnias without VAT.
- Prices for Goods and services may be changed by the Seller unilaterally depending on the market situation. At the same time, the price of a separate unit of Goods, the cost of which is paid by the Buyer in full, cannot be changed by the Seller unilaterally.
- The cost of delivery of the Goods and other related services is indicated on the website of the Internet store.

Rights and obligations of the parties
- The Seller undertakes:
- To transfer the Goods to the Buyer in accordance with the terms of this Agreement and the Buyer's order.
- Not to disclose any private information about the Buyer and not to provide access to this information to third parties, except in cases provided by law, or at the Buyer's request.
- The Seller has the right:
- To change the terms of this Agreement, as well as Tariffs (prices) for Goods and services, unilaterally, by posting them on the website of the Internet store. All changes take effect from the date of their publication.
- The Buyer undertakes:
- To familiarize oneself in advance with the content of the Agreement, the terms of the Agreement, and the tariffs (prices) offered by the Seller on the website of the Internet store.
- To provide the Seller with all necessary data that unambiguously identify him as the Buyer, and are sufficient for the delivery of the ordered Goods to the Buyer.
- The Seller undertakes:
Returns of Goods
- The buyer has the right to return to the seller non-food goods of proper quality if the goods did not satisfy him in terms of shape, dimensions, style, color, size, or for other reasons cannot be used for its intended purpose. The buyer has the right to return non-food goods of proper quality within 14 (fourteen) days, excluding the day of purchase. The return of non-food goods is carried out if they have not been used and if their commercial appearance, consumer properties, seals, labels, as well as the sales document issued to the consumer together with the sold goods, are preserved. The list of goods that are not subject to return on the grounds provided in this paragraph is approved by the Cabinet of Ministers of Ukraine.
- The refund of the cost of non-food goods of proper quality to the buyer is made within 30 (thirty) calendar days from the moment of receipt of such Goods by the Seller, provided that the requirements set forth in clause 6.1. of the Agreement, the current legislation of Ukraine are met. The cost of the goods is refunded by bank transfer. Delivery of non-food goods to the Seller's address is at the expense of the Buyer and is not reimbursed by the Seller to the Buyer.
- In case of defects in the Goods identified within the established warranty period, the Buyer, in the manner and within the time limits established by the legislation of Ukraine, has the right to make claims to the Seller as provided for by the Law of Ukraine "On Protection of Consumer Rights." When making claims for free elimination of defects, the time for their elimination is counted from the date of receipt of the Goods by the Seller. In this case, the delivery of small-sized Goods and Goods weighing less than 5 (five) kilograms to the Seller and their return to the Buyer are at the expense of the latter.
- The consideration of claims provided for by the Law of Ukraine "On Protection of Consumer Rights" is carried out by the Seller provided that the Buyer submits the documents provided for by the current legislation of Ukraine, including, but not limited to, a written application according to the sample available on the website gidrolica.ua.
- The Seller is not liable for defects in the Goods that arose after their transfer to the Buyer due to the Buyer's violation of the rules of use or storage of the Goods, actions of third parties, or force majeure.
Seller's Liability
- The parties are responsible for non-performance or improper performance of the terms of this Agreement in the manner provided for by this Agreement and the current legislation of Ukraine.
- The Seller is not responsible for changes in the appearance, equipment of the Goods made by the manufacturer.
- In case of force majeure circumstances, the parties are released from the performance of the terms of this Agreement. Force majeure circumstances for the purposes of this Agreement are events of an extraordinary, irreversible, unforeseen nature that exclude or objectively impede the performance of this Agreement, the occurrence of which the parties could not foresee and prevent by reasonable means.
- The conditions specified on the Website are preliminary conditions for the purchase of the Goods. The conditions for the purchase of the Goods may be changed by the Sellers after the order is accepted for execution.
- The Seller's liability for changes in the conditions of purchasing the Goods compared to those indicated on the Website is limited to the Buyer's right to refuse the purchase of the Goods and demand a refund of the amount paid for it (if it was actually paid by the Buyer before the transfer of the Goods).
Personal Data Protection
- By providing their personal data on the website of the online store during registration or when placing an Order, the Buyer voluntarily gives the Seller their consent to the processing, use (including transfer) of their personal data, as well as the performance of other actions provided for by the Law of Ukraine "On Personal Data Protection," without limiting the term of such consent. At the same time, the Participant consents to the transfer of their personal data to third parties.
- The Seller has the right to use and process information about the Buyer and the fact of their purchase of goods (works, services) without additional written consent from the Buyer, including information about the quantity, value, and assortment of purchased goods, the time and place of purchase, and to transfer such information to third parties. The Seller undertakes not to disclose the information received from the Buyer. The transfer by the Seller of information received from the Buyer to counterparties and third parties for the purpose of ensuring the implementation of purchase and sale relations, relations in the field of consumer rights protection, advertising, and marketing research, etc., is not considered a violation. The Buyer also consents to the transfer (dissemination) of their data to transport and courier organizations, any Banks and/or financial institutions, and other third parties (without limitation) at the discretion of FOP Verbitska N.P., as well as in cases where the disclosure of such information is required by the current legislation of Ukraine.
- The Buyer is responsible for keeping their personal data up to date. The Seller is not responsible for the improper performance or non-performance of its obligations due to the obsolescence of information about the Buyer or its inconsistency with reality.
- Personal data is deleted or destroyed in accordance with the requirements of the law of Ukraine "On Personal Data Protection." Personal data, in particular, are subject to deletion or destruction at the request of the data subject or in case of the data subject's withdrawal of the previously given consent to their processing.
Marketing and Advertising
- By registering on the website of the online store, the Buyer agrees to receive informational messages from the Seller and its partners, acting on the basis of an agreement with the Seller.
- At any time, the Buyer has the right to opt out of receiving such newsletters in the "My Account" section on the website of the online store.
- The website of the online store contains materials, trademarks, brand names, and other materials protected by law, including, but not limited to, texts, photographs, graphic images, music, and sound works.
- The content of the online store website is protected by the legislation of Ukraine.
- The Buyer or any other third parties do not have the right to use the materials posted on the website of the online store, including: making changes, copying, publishing, transmitting to third parties, etc.
Other Terms
- This agreement is concluded on the territory of Ukraine and is governed by the current legislation of Ukraine.
- All disputes between the Buyer and the Seller are resolved through negotiations. In case the disputed issue is not resolved through negotiations, the Buyer and/or the Seller have the right to seek resolution of the dispute through the judicial authorities in accordance with the current legislation of Ukraine.
- The Seller has the right to make changes to this Agreement unilaterally, as provided in clause 5.2.1. of the Agreement.
- This Agreement is valid until the parties fulfill their obligations in full, except in cases of early termination.
- Before the expiration of the term of this Agreement, it may be terminated by mutual agreement of the parties and in other cases provided for in this Agreement and the current legislation of Ukraine.
